Mother Sues Arkansas Hospital After They Donated Organs From Her Deceased Son Without Consent

Mother sues Arkansas hospital after they allegedly harvested and donated her 49-year-old deceased son’s organs without family consent. The news has since gone viral on social media, garnering lots of reactions from netizens.

The grieving mother, Irma Huckleby filed a lawsuit against Helena Regional Medical Center in eastern Arkansas, claiming that they showed ‘reckless disregard’ for her ‘severe mental and emotional pain.’

In the four-page lawsuit, Irma alleges that they removed several organs from her son, Kelly Huckleby. She added that the medical center donated them for transplant to other patients without the consent of his family, as reported by the Daily Mail.

Per the suit: “The defendants owed the Huckleby family a duty to use ordinary care for the safety and preservation of their loved one’s body.”

On March 11th, 2024, Irma’s son was found unresponsive in Helena, Arkansas, and was later pronounced dead at Helena Regional Medical Center. According to her, Kelly’s organs were donated without her consent.

In the lawsuit that was filed last month in Phillips County Court, the mother describes the actions of Phillips Hospital Company and its staff as “outrageous and intolerable.”

Kelly Huckleby’s obituary says he loved singing gospel songs and listening to Michael Jackson’s music. Having 9 siblings, he’s the oldest and reportedly stood by his faith despite facing so many challenges.

This is not the first time the US South will be facing allegations of dubious organ procedures. Back in April, families of five dead inmates sued the Alabama Department of Corrections and the University of Alabama, alleging that organs were harvested without consent.

According to the lawsuits at the time, autopsies at UAB shows that the inmates’ bodies were returned missing organs, which were not provided to the families regardless of their requests.
