A Black woman and her husband are seeking legal action after the doctor that delivered their baby reportedly killed him. The doctor used a vacuum on the baby’s head at least 15 times and bypassed guidelines for the procedure.

Back in February, 31-year-old Danielle Mackenzie, who was 40 weeks pregnant and her partner, Fabrice Diaz, arrived at Greenwich Hospital in Connecticut for the birth of their son.

Unfortunately, what was supposed to be a joyous moment turned into a nightmare. According to the Daily Mail, Dr. Jay Matut was suppose to only use the vacuum for 3 sets of pulls, based on NIH guidelines, but he instead used it 15 times on the baby’s head.

Mackenzie reportedly asked Matut for a c-section multiple times but was ignored, per the lawsuit. The baby eventually emerged from the womb with his head bleeding and swollen. Though he was transported to a different facility, he died after a few hours.

According to the lawsuit, “Matut acted with a reckless and conscious disregard for the safety of the infant in a situation where a high degree of danger was apparent.

As a result of the carelessness and negligence of Jay Matut, Danielle suffered and continues to suffer extreme psychological and emotional distress and impaired ability to carry on and enjoy life’s activities.”

The woman had already pushed for 90 minutes before the vacuum was applied and according to guidelines it wasn’t meant to be done again after failed attempts. “If there is no descent, further attempts should be discontinued and cesarean section considered.”

The doctor tried the vacuum again after 30 minutes and saw no progress so he gave an episiotomy, which helped her finally deliver. Once delivered, the baby did not cry and was limp with a low heart rate.

The grieving couple is seeking punitive damages for negligence, negligent infliction of emotional distress, and recklessness against Dr. Matut, the Westchester Medical Group, and Greenwich Hospital.
